9,000 car owners lose their case – do not get 1 billion from Volkswagen

In a class action against the Norwegian Volkswagen, 9,000 car owners had hoped to get up to DKK 1 billion in compensation. Now they have lost the case – again.

Dag Rune Flåten, together with 9,000 other Norwegian Volkswagen owners, has once again lost to the Norwegian part of Volkswagen AG and the importer.

If the lawsuit had been successful, the car owners would have had the prospect of getting between NOK 700 million and NOK 1 billion from the car manufacturer and its Norwegian importer.

But back in April, the case was rejected by the Oslo district court, and now the special Borgarting Court of Appeal has rejected the VW owners' appeal to look into the case anyway.

With the lawsuit, the 9,000 car owners wanted compensation because they bought diesel cars that the Volkswagen group produced for September 2015. Cars that the owners therefore believe are covered by the 'diesel gate' scandal.

But there will be no legal proceedings. The Appeal Board justifies the refusal by the fact that the Norwegian drivers have not necessarily bought the cars new in Norway. Some of them are also bought second-hand.

In addition, several of the cars were not bought directly from Volkswagen but in private transactions and from used car dealers. The motorists who feel cheated are not necessarily the first owners of the cars.

There will also be nothing of a lawsuit, although the car owners believe that Volkswagen has deceived both authorities and private individuals by claiming that the many diesel cars were more environmentally friendly than it turned out to be.

Volkswagen has already had to pay billions of kroner in damages and settlements with private car owners in other countries. The latest news is that Volkswagen's former CEO is now on trial in Germany for his role in dieselgate.

Martin Winterkorn, as he is called, denies having anything to do with the scandal. However, he has previously entered into a settlement with Volkswagen, who fired him due to the scandal.
