Expensive parking is illegal, says lawyer

Uwe Lenhart, who specializes in traffic law, believes it is clearly illegal to impose very high parking fees on some cars.

Although some German city councils would like to see it happen, it is clearly illegal to differentiate between the cars when the owners want to park in the cities.

Following the Parisian example, a number of German cities will make it significantly more expensive for SUV owners to park in the centre.

But before the politicians get too started, they might as well give up, says Uwe Lenhart. German law does not permit such discrimination.

The city of Koblenz, for example, will make it twice as expensive for the owner of a Volkswagen Tiguan to park. At least compared to what the owner of a Smart Fortwo has to pay.

But it doesn't work, says the lawyer, referring to as many as two Supreme Court judgments. In these judgments it is clearly stated that the cities must not have different prices for parking. At least not based on how big – or small – the cars are.

In the decisions from the federal court, it is stated, among other things, that a difference of 50 centimeters in length cannot justify that it suddenly has to be twice as expensive to park.

Cities such as Freiburg and Frankfurt have already had to scrap a similar practice. In Frankfurt, for example, the city government refused to issue resident licenses to drivers with SUVs. That is, until the city found out that this kind of discrimination is illegal.
